1. Introduction and Acceptance

These Terms & Conditions together with our Privacy Policy (“Terms”) will form a written contract between you and Hazendal Wine Estate (“Hazendal”, “we”, “us”, or “our”) and will govern your access to and use of the website, digital platforms, mobile apps, e-commerce store, booking systems, social media platforms or any other technology you use to interact with us (“Platforms”), and any products, services, experiences, events, reservations, memberships, and related offerings made available or offered by us (“Services”).

By accessing our Platforms, or otherwise engaging with our Services, you agree to be bound by our Terms. If you do not agree, you must refrain from using our Platforms or Services.

Some of our Platforms and/or Services may contain additional rules or terms from time to time, which may be relevant to specific Services you use or subscribe to. By using those Services, you agree to be bound by such additional rules and/or terms.

We reserve the right to amend our Terms at any time. Updated versions will be published on our website. Continued use of our Platforms or Services following any amendments constitutes acceptance of the revised Terms.

2. Use of Platforms

You agree to use our Platforms only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of our Platforms.

You may not:

  • Use the Platforms in any way that breaches applicable laws or regulations;
  • Attempt to gain unauthorised access to systems or data;
  • Introduce malicious code or interfere with Platforms functionality;
  • Use automated systems (including bots, scrapers, or spiders) to extract data without prior written consent.

3. Intellectual Property

All Content on the Platforms is the property of Hazendal or its licensors and is protected by applicable intellectual property laws. “Content” refers to any information, data, files, text, software, music, sound, photographs, graphics, images, video, messages, comments, hyperlinks or tags and other material appearing on our Platforms or Services and all applicable copyrights, trademarks, patents, logos or other intellectual property rights displayed on our Platforms or Services.

Content may be used for personal, non-commercial purposes only. No Content may be copied, reproduced, distributed, modified, or exploited without our prior written consent.

We will own all compilations, collective works or derivative works created by us which may incorporate your content. You grant us an irrevocable, perpetual, worldwide and royalty-free right and license to use, publicly display, publish, publicly perform, reproduce, distribute, broadcast, adapt, modify and promote on any medium, your content which you may upload or make available for inclusion on publicly accessible areas on our Platforms or through our Services. Any content you transmit or post to publicly accessible areas on our Platforms or Services shall be considered non-confidential and non-proprietary. We shall have no obligations with respect to such content. 

Our Platforms or Services may include, from time to time, advertisements from third parties and/or external links to other websites possessing their own content ("Third Party Content"). You acknowledge that the Third Party Content: (a) is beyond our control and that any reliance on any representation, statement or information contained in Third Party Content is at your risk; (b) is not verified by us; and (c) may contain representations, statements or information which does not represent the views, opinions or beliefs of Hazendal, its associates, directors or employees.

4. Products and Services

All orders placed through our online store or booking systems constitute an offer to purchase subject to our Terms and acceptance by Hazendal.

We reserve the right to:

  • Refuse or cancel orders;
  • Limit quantities purchased;
  • Correct pricing or description errors.

Descriptions, images, and pricing are provided in good faith but may be subject to change without notice.

5. Pricing and Payment

All prices are displayed in the currency indicated on the Platforms and include VAT where applicable unless otherwise stated.

Payment must be made via the methods provided at checkout. Orders will only be processed once payment has been successfully authorised.

Hazendal uses secure third-party payment processors. We do not store full payment card details.

6. Delivery

Delivery timelines and charges are indicated during checkout and may vary depending on location and availability.

While we endeavour to meet estimated delivery times, we are not liable for delays caused by circumstances beyond our reasonable control.

Risk in goods passes to you upon delivery. Ownership passes once full payment has been received.

7. Returns and Refunds

Our policy in respect of exchanges, returns and refunds depends on the type of Product or Services you purchase from us and the policy of the manufacturer or supplier thereof.

Returns and refunds are governed by applicable consumer protection legislation.

Where permitted:

  • Products must be returned in original condition and packaging;
  • Requests must be made within the legally prescribed timeframe;
  • Proof of purchase may be required.

You may be entitled to certain cooling-off rights. In other words, certain products may be returned within fourteen days of receipt for a full refund. 

Certain products or services may not be eligible for return, including:

  • Foodstuff, beverage or other goods intended for everyday consumption;
  • Goods made to your specifications or personalised goods;
  • Books, magazines or newspapers;
  • the provision of accommodation, catering (like our restaurant services) or leisure services (like our workshops and wine tasting services); 
  • event tickets; 
  • vouchers and discount coupons; and
  • services already provided.

Refunds will be processed to the original payment method where applicable.

8. Bookings, Events and Experiences

Reservations for tastings, dining, accommodation, events, or experiences may be subject to additional booking terms provided at the time of reservation.

Hazendal reserves the right to cancel or reschedule events due to unforeseen circumstances. Where cancellation occurs, alternative arrangements or refunds may be offered in accordance with applicable law.

Guests attending the estate do so at their own risk. Hazendal shall not be liable for loss, damage, or injury except where such liability cannot be excluded by law.

9. Vouchers and Promotional Codes

Gift vouchers and promotional codes:

  • Are valid for the period stated at time of issue, which shall not be less than 3 (three) years.  However, price increases may affect the value of your voucher.  You, or the recipient of the voucher will be liable to pay the difference between the voucher value and the increased price at the time of presenting the voucher;
  • May not be exchanged for cash;
  • Are non-transferable unless otherwise stated;
  • May be subject to specific usage conditions.

Lost, stolen, damaged or expired vouchers will not be replaced.

10. Sale of Alcohol

Alcoholic products will only be sold and delivered to individuals who are legally permitted to purchase alcohol in their jurisdiction (18 years or older in South Africa).

Hazendal reserves the right to request proof of age and to refuse supply where age verification cannot be satisfied.

11. Third-Party Services

 Our Platforms may contain links to third-party websites or offer third-party goods or services. Hazendal is not responsible for the content, policies, or performance of third-party providers.

Any engagement with third parties is at your own risk and subject to their terms and conditions.

12. Availability of Platforms

We aim to ensure that our Platforms and Services are available at all times; however, we do not guarantee uninterrupted access.

Access may be suspended temporarily for maintenance, updates, or technical reasons without notice.

13. Limitation of Liability

You use our Platforms and Services at your own risk.

While we endeavour to ensure that the information on our Platforms is correct, we do not warrant the accuracy and completeness of Content on our Platforms or that the Content and technology available from our Platforms or Services are free from defects, errors or omissions.

Our Platformss and Services are supplied on an "as is" basis and have not been compiled or supplied to meet any user's individual requirements. It is your sole responsibility to satisfy yourself prior to entering into this agreement with us that the Products and Services available on or through our Platforms will meet your individual requirements.

To the fullest extent permitted by law:

  • Hazendal shall not be liable for indirect, incidental, consequential, or special damages arising from the use of our Platforms or Services.
  • Liability for direct damages shall be limited to the amount paid for the relevant product or service giving rise to the claim.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

14. Indemnity

You agree to indemnify and hold harmless Hazendal, its directors, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from your misuse of our Platforms or breach of these Terms.

15. Security and Privacy

Personal information is processed in accordance with our Privacy Policy, available on our website at www.hazendal.co.za.. 

We will be entitled to take whatever action we may deem necessary and reasonable to preserve the security and reliability of our Platforms and/or Services.

We take reasonable steps to secure your payment information. We use a payment system that is in our reasonably opinion sufficiently secure with reference to accepted technological standards and the type of the transaction concerned.

16. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

You consent to the exclusive jurisdiction of the courts of South Africa in relation to any dispute arising from these Terms or your use of the Platforms or Services.

17. How to resolve a dispute with us

We offer the following process to help you resolve a complaint or dispute you may have with us.

  • Contact our customer support department - any queries or complaints in relation to our Platforms or Services can be submitted to us by contacting us at info@hazendal.co.za or any of the numbers found on our Platforms.
  • Send us a notice of a legal dispute  - without prejudice to your rights in law, you are required to first approach us with any complaint or dispute and afford us an opportunity to resolve a compliant before you approach any relevant authority, court or other dispute resolution body, or refer the matter to arbitration as contemplated below. 20 General terms

  • These Terms are the sole record of the agreement between you and us, with neither party being bound by any express, tacit or implied representation or warranty not recorded in these Terms.
  • No agreement shall be concluded or amendment to these Terms effected merely by you sending a data message to our Platforms.
  • We may transfer our rights and obligations under the Terms to a third party without your consent.
  • You may not transfer your rights and obligations under the Terms to a third party without our consent.
  • If any provision of the Terms is or becomes unenforceable for any reason, then such provision will be treated as if it had not been included in the Terms to the extent that it remains unenforceable and shall not affect the validity of the remaining provisions of the Terms.
